    11th Circuit Sides With NASCAR in Logo Dispute With AT&T

    A ruling by the 11th Circuit cleared the way for NASCAR to prevent AT&T from featuring its logo on Jeff Burton's No. 31 Richard Childress Racing Chevrolet. The court said Monday in its order that AT&T lacks standing to challenge NASCAR's decision, and threw out a lower court's ruling that prevented NASCAR from stopping AT&T's plans. At issue is AT&T's desire to change the Cingular logo on Burton's car, which was grandfathered into a NASCAR and Sprint Nextel exclusivity agreement, to the AT&T logo.

    Dr. Karen Rudolph's work as a wildlife DNA specialist in Idaho is helping prosecutors win convictions.Dr. Karen Rudolph didn't have much time. Investigators had turned to the DNA expert after finding a knife with traces of blood in a suspect's truck. A few hairs were discovered at the crime scene hundreds of miles away, and authorities wanted to know if there was a link.

    Two days later, working on delicate equipment in a state lab, Rudolph had an answer: The DNA on the knife was a match to the hair strands.

    The suspect was arrested and charged -- with poaching.

    As the state's only wildlife DNA specialist, the 44-year-old Horseshoe Bend resident handles evidence for many of Idaho's animal-related cases.

    Rudolph's job requires her to identify an animal based on a hunk of tissue, wayward tuft of hair, bone chip or dried splatter of blood.

    In many cases, her work has helped prosecutors win convictions and encouraged defendants to plead guilty without going to trial, officials said.

    Jury Re-enacts Shooting

    Phil Spector and his wife somberly stood arm in arm Thursday as they watched jurors weave under crystal chandeliers, past a suit of armor and to the red-carpeted foyer in the music producer's mansion, where actress Lana Clarkson died.

    In every room there were blowup photos that have been in evidence at Spector's murder trial, showing the scenes the jurors were viewing. There were several bloody photographs of Clarkson's body slumped in a chair in the foyer.

    Some jurors, trying to duplicate the crime scene, sat in a replica of the chair in the position in which the actress was found on February 3, 2003, dead of a bullet wound through the mouth.

    The crime shocked residents of Newark, New Jersey, galvanizing them to express their outrage at the city's street violence.

    Jose Carranza, 28, was formally charged in Essex County Superior Court with murder, attempted murder, robbery and various conspiracy and weapons offenses.

    Bail was set at $1 million.

    Nacchio Judge “Ashamed” of Strip-Club Outing

    nottinghamEdward Nottingham, the chief federal judge in Denver fresh off the Joe Nacchio trial, made headlines in the Mile High city last night. 9News reported that Judge Nottingham's wife ended their three-year-old marriage after she discovered more than $3,000 in receipts from a Denver strip club. Here's a story from the Rocky Mountain News.

    9WantsToKnow said the information is contained in transcripts of their divorce proceedings. "I'm ashamed and mortified just telling you that is the Diamond Cabaret . . . a topless establishment," he testified. He also reportedly said he couldn't recall how he could have spent so much at the strip club. "I had had a lot to drink . . . and I don't remember," he said, according to the transcript.

    The transcript also reportedly showed that Nottingham was asked about credit card charges for a Web site called Ipayfriendfinder.com, which he called "a dating site - an Internet dating site." Of a $150 charge he made to Ipayfriendfinder.com, Nottingham reportedly said, "I'm embarrassed to be even talking about this. I think you pay extra to get certain features, such as if you upload a picture or - I don't even recall."

Last month the Minnesota Supreme Court ruled in his favor, and the source code will be turned over the defendant's attorneys.

    Campos Decamps From SEC . . . For Cooley?

    Roel CamposSEC Commissioner  announced today that he intends to leave the agency next month for the private sector. Campos, one of the agency's Democratic commissioners, was appointed by President Bush in 2002. The second Democrat on the commission, Annette Nazareth, will leave by year-end, according to Newswires.     A Father-Son Chat We’d Love to See on YouTube!

    Philippe DaumanWSJ editor Martin Peers and WSJ reporter Kevin Delaney recently put their collective talents together and graciously threw the Law Blog the following post:

    His father is doing battle in a massive lawsuit with the company. But that's not enough to stop Philippe Dauman Jr. from going to work for Google.

    Dauman's dad, Philippe Dauman (pictured, left), is none other the CEO of Viacom, which earlier this year lodged a $1 billion copyright infringement lawsuit against the Internet titan. Dauman, a partner at Shearman & Sterling before going in-house at Viacom in 1993, didn't mince words about Google at the time:

    "It's hard for us to believe that [Google] has any desire to protect our content," Dauman said in a March interview. In the still-pending suit filed in U.S. District Court in New York, Viacom alleged that the availability of copyright works on Google's YouTube video sharing site "is the cornerstone of [its] business plan" and accused it of using technology to "willfully infringe copyrights on a huge scale . . . and profiting from the illegal conduct of others as well."

    The Trials of Ave Maria School of Law

    Ave Maria School of LawMuch has been written in recent weeks about Ave Maria, the town outside Naples, Fla., that Domino's Pizza founder Tom Monaghan has built as a sort of utopia for devout Catholics and others (click here here and here for coverage of the Florida town and university).

    But a recent series of events at the Ave Maria School of Law - founded by Monaghan in Ann Arbor, Mich., in 2000 - threaten to throw a hurdle into the completion of his vision, raising the possibility that the school might not retain its accreditation when it moves to Florida, set for 2009.

    The controversy, which has pitted the school's dean, Bernard Dobranski, against a cadre of faculty members, took off in 2006, during a period when the school's board of governors began to look seriously at moving the school.

    In April of that year, the majority of faculty issued a resolution against Dobranski and sent a formal complaint to the American Bar Association, alleging he excluded them "from any meaningful role in deciding the propriety of a re," intimidated faculty members into not openly opposing, and prevented faculty from participating in major parts of the school's education program, among other things. More recently, tenured faculty have said Dobranski ended their salary raises and removed them from key faculty posts.     As a result of the tumult, two professors and two lecturers have left the school since last year, and one professor took a leave of absence.
